Oral argument gets a great deal of public attention, but it’s the briefs that drive how Judges decide cases and write their opinions.
Topics to be covered will include:
• What is the most consequential error that advocates make in their briefs?
• How does technology affect how Judges read briefs?
• What’s the best way for attorneys to address weaknesses in their cases in briefs?
• How do Judges incorporate what is in the briefs into their opinion writing?
• To what extent do Judges try to reach agreement in conference and in the process of opinion writing?
